Wakefield Associates terms and conditions and client care information.

      We advise that we must:

  • act competently, in a timely way, and in accordance with instructions received and arrangements made:
  • protect and promote your interests and act for you free from compromising influences or loyalties:
  • discuss with you your objectives and how they should best be achieved:
  • provide you with information about the work to be done, who will do it and the way the services will be provided:
  • charge you a fee that is fair and reasonable and let you know how and when you will be billed:
  • give you clear information and advice:
  • protect your privacy and ensure appropriate confidentiality:
  • treat you fairly, respectfully, and without discrimination:
  • keep you informed about the work being done and advise you when it is completed:
  • let you know how to make a complaint and deal with any complaint promptly and fairly.

 

The obligations owed to clients are described in the Rules of conduct and client care for lawyers (the rules).

Who is responsible for your work?

Garry Wakefield will have overall responsibility for the work on this matter.

 

Lawyers’ Fidelity Fund and Professional Indemnity Insurance

The Lawyers’ Fidelity Fund provides a limited form of cover for protection against theft by lawyers up to specified maximums in certain circumstances – excluding investment monies.  We do not deal with investment monies.  We do not hold professional indemnity insurance.

 

Complaints

We will respond to any complaint promptly and fairly.  If you have a compliant about our services please tell Garry directly.  Alternatively, if you do not want to take your complaint to Garry, please contact Fiona Wakefield, solicitor by email at fiona@mwlaw.co.nz. If you cannot resolve your complaint to your satisfaction you may contact the Law Society complaints service. Please phone 0800 261 801 if you need to make contact with this service.

 

In the event that Wakefield Associates are not successful in establishing the Corporation is liable to make payment in regard to any entitlement that I may have, then no fee for our services or out of pocket expenses is payable by me.

      

In the event that Wakefield Associates establish the Corporation is liable to make payment in regard to any entitlement I may have, then in consideration of services rendered and to be rendered by Wakefield Associates, I will pay to Wakefield Associates:

      (a)   25% ((Twenty-five percent) plus GST) of all recovery; and

      (b)   All of the first quarterly award made by ACC (inclusive of GST);

I agree to do and now authorise Wakefield Associates to deduct from payments made by the Corporation to Wakefield Associates on my behalf the sums referred to in this clause.
